Ems Recommendations Essay Riordan Manufacturing wants to improve its sustainability practices. In this paper Learning Team C summarizes the business audit assessments on Table one that contains important objectives, targets, and programs involving sustainability. The next section identifies and summarizes the relevant technologies, strategies, products, and practices that increase sustainability. Learning Team C also identifies three best practices that Riordan Manufacturing should consider implementing by describing new items or practices to implement, a summary of cost-benefits, justify why benefits outweigh the costs, and implementation steps for the new items. The last section is a discussion about if the EMS recommendations eliminate the need to comply with state or federal regulations. Assessments Summary Environmental policy will require objectives that focus environmental actions to achieve targets that use quantifiable measures with specific endpoints that relate to the objectives and develop progressive goals that responsible partiesââ¬â¢ actions must achieve. In the appendix Table one the Development of Environmental Policy Commitment is an assessment summary nonsustainable process, objectives, target, programs, and responsible party at Riordan Manufacturing four locations Michigan, California, Georgia, and China. Beginning with policy commitment, the rows develop nonsustainable initiatives that Riordan should commit to resolve at each facility. The next column objectives provide the specificity of nonsustainable operational areas that align to specific task for focusing resources and efforts. Targets are quantifiable goals in percentages and have a definite ending point for concluding actions reflect periods of a year or months. The environmental program found on table one are a result from planning activities by the responsible party who is accountable for the activities of the implementation team. The responsible party will represent each environmental policy and the selection of each employee was on interest basis to establish an environmental management system at Riordan. This list of individuals is not exhaustive and additional employees with skills and interest may join to assist responsible parties achieve policy objectives. According to Wilson and Sasseville (1999) it is important to remember when developing a new environmental management system takes no single approach for assigning responsibilities and in small companies an individual may have to handle several functions. Technology, Strategies, Products or Practices The Environmental Protection Agency (2002) describes the permanent total enclosure (PTE) as a capture device that collects and vents organic hazardous air pollutants (HAP) and volatile organic compounds (VOC) to an abatement device. The PTE can be permanent or temporary enclosures that must pass a five point Environmental Protection Agency Method 204 the Criteria and Verification of a Permanent or Temporary Total Enclosure to qualify as an PTE. Once the criteria are met the PTE is assumed to have 100% capture efficiency. If Riordan chooses an PTE the organization can avoid the need for frequent capture efficiency test. The PTE meets or exceeds requirement by the National Emissions Standards for Hazardous Air Pollutants (NESHAPs). This technology can align to Triple Bottom Line minimization strategy by reducing hazardous air pollutants in addition to improving worker health and safety throughout the receiving and molding operations at Rior dan facilities. The energy performance indicators (EPI) are technology that the Environmental Protection Agency supports to manage how manufacturing plants use energy and compares to the industry standard. Riordan Manufacturing may obtain an Environmental Protection Agency energy performance indicator through Energy Star. Operational energy use data enter the device and an energy efficiency test follows the Environmental Protection Agency scoring guidelines on a scale of one to 100 that compares results against nonpublic Census Bureau data. An accurate measurement of energy using EPI technology as a tool produces benefits that reduce energy waste and can align with a minimization sustainability strategy that decreases fossil fuel use. Riordan can address their need to find a sustainable method of treating waste water produced during the molding and mixing processes by partnering with a company already utilizing Ultrafiltration systems to eliminate ground contamination. Ultra filtration (UF) is a pressure-driven process that removes emulsified oils, metal hydroxides, colloids, emulsions, dispersed material, suspended solids, and other large molecular weight materials from water and other solutions. Three Best Practices Riordan Manufacturing has three best practices this organization may choose to implement at the four manufacturing facilities that reduce three nonsustainable practices in the receiving and molding operations with byproducts of air pollution, water contamination, and energy waste. First, Riordan Manufacturing plants emit a volatile organic compound (VOCs) during plastic-injection creating a hazardous air byproduct that contributes climate change. Riordan Manufacturing may combat VOC air emissions at the four facility locations by implementing a permanent total enclosure (PTE) or 100% capture room that contains harmful air pollutants effects from over spraying fugitive pollutants into the atmosphere. The second practice will combat ground and water contamination that streams from continual material spills in the receiving, and molding areas. A best practice to follow is requiring departments to reuse water throughout the manufacturing process and separate chemicals with a Ultrafiltration system. Small Business Division (2004) writes a Ultrafiltration system treat wastewaters by separating the fluids before it discharges remains into the sewer system. The third practice for Riordan Manufacturing to combat is energy waste and should implement Energy Performance Indicators (EPIs) to benchmark energy consumption the four its manufacturing plants. Most energyà waste comes from equipment settings, machinery left on during nonoperational hours, lighting, heating, and cooling at the four facilities. Machinery will perform better and reduce its energy consumption by cleaning and maintaining it properly, in addition to performing energy saving shutdowns. The second best practice to consider is implementing energy reduction of facility lighting systems. According to Energy Star (n.d.) ââ¬Å"Replace old fluorescent and incandescent lighting with T-8s, ENERGY STAR qualified compact fluorescent light bulbs (CFLs) and other energy-efficient lighting systems, and implement a regular lighting maintenance programâ⬠(p. 1). New Business Practices Implementation Cost Riordan should review the cost of pursuing air emission reduction; minimizing ground and water contamination, and energy conservation procedures before implementing the above-mentioned EMS recommendations. The initial cost includes time to evaluate and educate leaders, management, and employees on new practices and procedures. Riordan will need to review the environmental cost of pursuing PTE at the China facility to determine what government regulation are obstacles and effect implementation of an EMS for air pollution. Potential financial costs include equipment maintenance for the PTE, especially the control device that must perform at an optimum energy savings capacity. Another environmental cost is for new energy efficient equipment to replace older inefficient machinery and the cost of adapting facilities to include a Ultrafiltration system. The implementation of an energy maintenance system that measure energy use is another financial cost in association with thec entire EMS recommendations. New Business Practices Benefits Facts prove the initial investment that transition a business practice to pro-environment policies is enabling many businesses to expand operations to enhance long-term endurance and profits. A short-Term advantage to an eco-friendly shift is the satisfaction that company actionsà are sustainable and may permit operations to earn more profits, boost a healthier environment, gain cost reductions, expand into new markets, and develop employee motivation and health. Long-term gain can include a substantial economic performance by attracting socail responsible investors who prefer the practices of a sustainable company. New Practices Implementation Steps To implement Riordan Manufacturing new sustainable policies and targets, responsible parties should take steps to implement the new environmental policies items. According to Wilson (1999) ââ¬Å"The most important steps is to begin to focus your people and available resources toward the strategy and structure of your EMSâ⬠(p. 109). To implement an EMS, Riordan should follow six steps 1. Assessment and Evaluation of current policies and proposed policies. 2. Planning and Organizing 3. Developing and establishing communication with internal departments and external groups 4. Training in new procedures and policies 5. Ensuring Operational Control 6. Implement EMS Plans Regulations Compliance Riordan Manufacturing deals in the development of plastic molding injection products that affect the environment. The new regulatory standards improve the identification of air quality issues and take appropriate measures to resolve quickly compliance issues when situations arise, for example long-term worker health problems from exposure to high levels of Volatile Organic Compounds (VOC) emissions. Manufacturing organizations are under scrutiny to provide a safe environment. The EPA uses stringent guidelines that businesses must follow if businesses want to alleviate financial burdens from fines and legal actions. Riordan Manufacturing EMS recommendations support environmental policies by using sustainability practice and reduce potential risk of violating regulations that the EPA enforces. The actions for establishing the EMS recommendation do not eliminate the need to comply with the state and federal regulations and permits Riordan to use sustainable practices to improve operations. Conclusion Learning Team C in this paper uses recommendations to explain the necessary consideration that Riordan Manufacturing should factor when developing and implementing sustainability practices at the four plantà locations. This information should provide a good foundation for weighing the cost and benefits of increasing sustainability using strategies that incorporates technology, products, and practices that change how a traditional manufacturer operates. Hofstedes Cultural Dimensions in Australia The word culture stems from a Latin root that means the tilling of the soil, like in agriculture. In many modern languages the word is used in a figurative sense, with two meaning. The first meaning which is more commonly used is civilization, including education, manners, and arts and crafts and their products. It is the domain of a ministry of culture. The second meaning is derived from social anthropology, but in the past decades it has entered common parlance. It refers to the way people think, feel and act (Hofstede, G. Et al. 2011). According to Geert Hofstede, Culture is the collective programming of the human mind that distinguishes the members of one human group from those of another. Culture in this sense is a system of collectively held values (Geert Hofstede). Categories can refer to nations, regions within or across nations, ethnicities, religions, occupations, organizations, or the genders. He also spoke about culture as the software of the mind that guides us in our daily interactions. Another definition of culture according to Edgar Schein is, Culture is the deeper level of basic assumptions and benefits that are shared by members of an organisation that operate unconsciously and define in a basic taken for granted fashion an organisations view of its self and its environment (Edgar H. Schein. 2004). *According to Peterson (2004), Culture is the relatively steady set of inner values and beliefs commonly held by groups of persons in countries or regions and the visible impact those values and beliefs have on the populations outward behaviour and environment. Hence, culture includes many elements which include behaviour, knowledge, motives, ideas, and customs that differentiate the members of one group from another (Neelankavil and Rai, 2009). The aim of this essay is to discuss and evaluate the key dimensions of national culture of Australia using the cultural dimensions model developed by Hofstede which is based on an extensive study of how values in workplace are influenced by culture. A particular culture will be rated against five distinct categories. These dimensions are Power Distance, Uncertainty Avoidance, Individualism versus Collectivism, Masculinity versus Femininity and Long Term Orientation (Hofsted, 2001). I will also discuss some limitations and criticism of the Hofstede Model of Culture Dimensions, concluding my discussion with a brief summary at the end. National Culture of Australia: *Australia is a well developed country making marks in the world economy. Australian Culture echoes the nations exceptional unification of different cultures. Australias diverse culture and lifestyle reflect its liberal democratic traditions and values, geographic closeness to the Asia-Pacific region and the social and cultural influences of the millions of migrants who have settled in Australia since World War II. Australia is a product of a unique blend of established traditions and new influences. The countrys original inhabitants, the Aboriginal and Torres Strait Islander peoples, are the custodians of one of the worlds oldest continuing cultural traditions (Australiacountrybook. 2011). Australia culture has grown to be one of the most diverse cultures of the world. Heavily influenced by Anglo-Celtic origins the culture of Australia has also been shaped by multi-ethnic migration which has influenced all aspects of Australian life, including business, the arts, cooking, sense of humour and sporting tastes. Australian culture is based on the following principles: Productive diversity- All the people should uplift the cultural, social and economic values. And Cultural respect- All the people of Australia can practice their own religion and culture. Today Australia has a population of more than 21 million people (World News Network. 2011). Hofstedes Cultural Dimensions framework of Australia Power Distance: Power distance is the extent to which less powerful members of institutions and organizations within a country expect and accept that power is distributed unequally. (Hofstede, 2001). This represents inequality (more versus less), but defined from below, not from above. It suggests that a societys level of inequality is endorsed by the followers as much as by the leaders (Geert Hofstede. (2009). In high power distance cultures the following things are observed. Those in authority openly demonstrate their rank. Subordinates are not given important work and expect clear guidance from above. Subordinates are expected to take the blame for things going wrong. The relationship between boss and subordinate is rarely close/personal. Politics is prone to totalitarianism. Class divisions within society are accepted and parents are more highly respected and corporal punishment is more common (Hofstede on Cultural Awareness. 2011). In comparison in low power distance cultures the following things are observed. Superiors treat subordinates with respect regardless of their rank. Subordinates are entrusted with important assignments and tasks. If things go wrong, the blame is generally shared or very often accepted by the superior due to it being their responsibility to manage. Managers may often socialise with their subordinates. Liberal democracies are the norm and societies lean more towards egalitarianism. Power Distance in Australia: Power Distance (PDI) in Australia is relatively low, with an index of 36, compared to the world average of 55. This is indicative of a greater equality between societal levels, including government, organizations, and even within families. This orientation reinforces a cooperative interaction across power levels and creates a more stable cultural environment (Australian Business Culture. 2011). A low power distance implies that power in Australia is spread out to everyone instead of being reserved to a few groups. This relatively low score implies that Australians believe that they are close to power, that they should have access to that power, that the powerful and the powerless should try to live in concert with each other, and that a hierarchy is an inequality of roles established for convenience (Samovar and Porter, 1991). Uncertainty Avoidance: Uncertainty Avoidance deals with a societys tolerance for uncertainty and ambiguity; it ultimately refers to mans search for truth. It indicates to what extent a culture programs its members to feel either uncomfortable or comfortable in unstructured situations. Unstructured situations are novel, unknown, surprising, and different from usual. Uncertainty avoiding cultures try to minimize the possibility of such situations by strict laws and rules, safety and security measures, and on the philosophical and religious level by a belief in absolute truth; there can only be one truth and we have it. People in uncertainty avoiding countries are also more emotional, and motivated by inner nervous energy. The opposite type, uncertainty accepting cultures, are more tolerant of opinions different from what they are used to; they try to have as few rules as possible, and on the philosophical and religious level they are relativist and allow many currents to flow side by side. People within thes e cultures are more phlegmatic and contemplative, and not expected by their environment to express emotions (Geert Hofstede. 2009). Some of the common traits found in countries that score highly on the uncertainty avoidance scale are as follows. They are usually countries/cultures with a long history, where the population is not multicultural, i.e. homogenous. Where risks, even calculated, are avoided in business and where new ideas and concepts are more difficult to introduce (EuroAfricaCentral Network Multicultural Communication Training. 2009). In comparison, some of the common traits found in countries that score low on the uncertainty avoidance scale are as follows. They are usually countries with a young history and where the population is much more diverse due to waves of immigration. Where risks are embraced as part of businesses and innovation and pushing boundaries is encouraged (Hofstede on Cultural Awareness 2011). Uncertainty Avoidance in Australia: The Geert Hofstede analysis shows the high level of individuality Australians hold dear. This is reinforced in their daily lives and must be considered when travelling and doing business in the Country. Privacy is considered the norm and attempts at personal ingratiation may meet with rebuff. Uncertainty avoidance is relatively low with a family centred culture and a stable society (Geert Hofstede. (2009). Australia received a score of 27 on the scale of Uncertainty Avoidance. This score implies that Australians do not like uncertainty, that they want stability for members, they strive for consensus, follow many rules, and tend to have more stress and anxiety (Samovar and Porter, 1991). Individualism/collectivism: According to Hofstede (2001), individualism/ collectivism refer to the extent to which individuals are integrated groups. *Individualism is the opposite of collectivism; together they form one of the dimensions of national cultures. Individualism stands for a society in which the ties between individuals are loose: everyone is expected to look after himself or herself and his or her immediate family only. People in individualistic cultures emphasize their success/achievements in job or private wealth and aiming up to reach more and/or a better job position (International Business Cultures. 2010). Collectivism stands for a society in which people from birth onwards are integrated into strong cohesive in groups, which throughout peoples lifetime continue to protect them in exchange for unquestioning loyalty. Alexandra Giroux. (2011). Highly individualist cultures believe that an individual is the most important unit. In this kind of culture people only take care of themselves and their immediate family. People are self orientated. Identity is based on individual. It is also a kind of a guilt culture. People make decisions on their individual needs. Emphasis is on individual initiative and achievement and everyone has a right to a private life (Ann P. Copeland. (2011). *In comparison, highly collective cultures believe that an individual is the most important unit. In this kind of culture people expect absolute loyalty to a group i.e. extended family. It is group oriented and decisions are based on what is best for the group. Identity is based on a social system and it is also a kind of shame culture. Dependence on organisation and institutions i.e. expects organisations/institutions/groups to take care of an individual. There is an emphasis on belonging and private life is invaded by institution and organisations to which one belongs to. Individualism in Australia: The Geert Hofstede analysis for Australia reflects the high level of individuality Australians hold dear. The Individualism (IDV) index for Australia is 90, the second highest score of any country in Hofstedes survey, behind the United States ranking of 91. This individuality is reinforced in Australians daily lives and must be considered when travelling and doing business in their Country. Privacy is considered the cultural norm and attempts at personal ingratiating may meet with rebuff (International Business Centre. (2008). Masculinity/Femininity: This dimension indicates the extent to which dominant values in a society tend to be assertive and look more interested in things than in concerning for people and the quality of life. Masculinity is the opposite of femininity; together, they form one of the dimensions of national cultures (International Business Cultures. (2010). According to Hofstede, Masculinity stands for a society in which social gender roles are clearly distinct: Men are supposed to be assertive, tough, and focused on material success; women are supposed to be more modest, tender, and concerned with the quality of life. Femininity stands for a society in which social gender roles overlap: Both men and women are supposed to be modest, tender, and concerned with the quality of life. (Hofstede (2001). Masculine cultures tend to be ambitious and need to excel. Members of these cultures have a tendency to polarize and consider big and fast to be beautiful. In workplaces employees emphasize their work to a great extent (live in order to work) and they admire achievers who accomplished their tasks. Feminine cultures consider quality of life and helping others to be very important (Hideyuki SUGAWARA. (2009). A High Masculinity ranking indicates the country experiences a high degree of gender differentiation. In these cultures, males dominate a significant portion of the society and power structure, with females being controlled by male domination. A Low Masculinity ranking indicates the country has a low level of differentiation and discrimination between genders. In these cultures, females are treated equally to males in all aspects of the society. Masculinity/Femininity in Australia: *The Geert Hofstede analysis for Australia in relation to masculinity reflects almost 58% population is male dominated which is just below half level at 48% compared to the rest of the world. This shows that females still are not considered equal to men in different fields of life; however, femininity equality rights are increasing rapidly in Australia according to some online statistics and reports. Long Term Orientation: Long-Term Orientation (LTO) focuses on the degree the society embraces, or does not embrace long-term devotion to traditional, forward thinking values. High Long-Term Orientation ranking indicates the country prescribes to the values of long-term commitments and respect for tradition. This is thought to support a strong work ethic where long-term rewards are expected as a result of todays hard work. However, business may take longer to develop in this society, particularly for an outsider. A Low Long-Term Orientation ranking indicates the country does not reinforce the concept of long-term, traditional orientation. In this culture, change can occur more rapidly as long-term traditions and commitments do not become impediments to change (International Business Centre. 2008). A long term orientation is characterized by persistence and perseverance, a respect for a hierarchy of the status of relationships, thrift, and a sense of shame. Countries include China; Hong Kong; Taiwan, Japan and India. A short-term orientation is marked by a sense of security and stability, a protection of ones reputation, a respect for tradition, and a reciprocation of greetings; favours and gifts. Countries include: Britain, Canada, the Philippines; Germany and Australia (Robert Paterson. (2003). High long term orientation cultures will show respect to traditions and longer work commitments, this is because one believe rewards will come following work even if it is not immediate. Long term rewards are expected for work done today. Low long term orientation societies do not confirm to traditions and long term rewards. Traditions and commitments in cultures with low long term orientation are likely to change with time (Confucius Institute. (2008). Long Term Orientation in Australia: Long term orientation in Australia is at 30% which is just below half level at 44% compared to the rest of the world. This shows that long term orientation is at a low level in Australia. This might also means that Australia leans more towards short term orientation than long term. Limitations of the Hofstede Model of Culture Dimensions: Even though Hofstedes model is generally accepted as the most comprehensive framework of national cultures values, its validity and its limitations have been extensively criticized. Certain criticism has been raised such as the following. Firstly, the averages of a country do not relate to individuals of that country. Even though this model has proven to be quite often correct when applied to the general population, one must be aware that not all individuals or even regions with subcultures fit into the mould. It is to be used as a guide to understanding the difference in culture between countries, not as law set in stone. As always, there are exceptions to the rule. Secondly, there is no certainty concerning the accuracy of the data. The data has been collected through questionnaires, which have their own limitations. In some cultures the context of the questions asked are as important as their content. Especially in group orientated cultures, individuals might tend to answer questions as if they were addressed to the group he/she belongs to. Lastly, the question is as to how up to date is the data considering factors such as how much does a country change over time, either by internal or external influences. Conclusion After discussing in detail, Hofstedes Cultural Dimensions framework for Australia, it can be seen that the power distance situation in Australia is relatively low. A low power distance implies that power in Australia is spread out to everyone instead of being reserved to a few groups. This also indicates that there is good equality between social level, including government, and organisations. This orientation reinforces a cooperative interaction across power levels and creates a more stable cultural environment. In relation to uncertainty avoidance, it is also relatively low with a family centred culture and a steady society. It can also be seen that Australians do not like uncertainty, that they want stability for members, they strive for consensus, follow many rules, and tend to have more stress and anxiety. It can also be witnessed that there has been a high level of individuality. The masculinity / femininity level seems to be balanced as well with both genders sharing equality in business and ethics. As for orientation, you can see both long and short term as Australia is a product of a unique blend of established traditions and new influences. Overall this portrays that Australia has come a long way from where it once stood has improved on many issues and fields heading towards a strong, solid and promising future in terms of culture.

COPs and their Disadvantages Manage the mutual relationship by fostering institutional cooperation and coordination. Such cooperation could take place simply through information exchanges between treaty bodies, or in a more ambitious form comprising joint planning of programmes or even the coordination of substantive decision-making or implementation activities. It argues that this soft alternative also has its limitations, which can be explained by incongruent memberships and limited legal mandates. Although the institutional cooperation efforts to address the interactions between the climate and biodiversity regime are clearly intensifying, their effects are as of yet uncertain: at best, they can be seen as creating mutual awareness and building capacity at various levels; at worst, they can be viewed as an exercise in rhetoric. First, any effort by actors in one reg ime to influence rule development in another will be limited by the extent to which memberships are congruent. In this case, an important barrier is that the United States is a party to the UNFCCC, but not to the CBD. A broad mandate for the climate regimes treaty or administrative bodies to cooperate with the CBD could lead to the perception that state sovereignty is eroded by importing concepts or rules from the CBD.304 A submission by the United States to the UNFCCC seems to confirm this fear. Commenting on the paper concerning options for enhanced cooperation prepared by the Joint Liaison Group in 2004, the United States notes that the Rio Conventions have a distinct legal character, mandate and membership.305 Although this limitation may not have to hold for the Kyoto Protocol-to which the United States is not a party after all-the secretariats mandate for cooperation is determined by the UNFCCC COP rather than the Kyoto Protocols COP/MOP. More generally, it shows that parties in the climate regime may not be ready to give biodiversity conservation a more prominent place at the expense of achieving cost-effective emission reductions. Legal solutions The notion of conflict resolution leads to the second explanation of why legal techniques are not necessarily the most appropriate means to manage regime interactions: it is not always desirable that one norm prevails over another. Yet such a view ignores the notion that different treaties may pursue similar or overlapping objectives. This is particularly pertinent in the field of international environmental law. In the context of the interactions between the climate and biodiversity regimes, this would mean that any satisfactory resolution needs to result in further greenhouse gas emission reductions, while simultaneously ensuring the conservation and sustainable use of biodiversity. My main point is that the focus on normative conflict has overshadowed the idea that norms may also reinforce each other. There is, for instance, a strong argument for using the concept of sustainable development as an overarching objective for international environmental law, and perhaps even internati onal law more generally. The ILC Study Group report has not completely ignored this critique. In its discussion of conflict clauses, the report acknowledges that in some cases it is necessary to put in place a clause that avoids a straightforward priority and instead seeks to coordinate the simultaneous application of the two treaties as far as possible. This is in line with Chambers, who suggests that [t]here is a need to create a positive rule of cooperation . . . which promotes treaty negotiators and treaty interpreters to maintain consistency between treaties. too narrowly focused on conflicts. Conflict resolution rules resulting in a hierarchical relationship of norms may still be useful in conflicts between legal regimes with incompatible objectives, but management of interactions between environmental treaties more generally may be better achieved through conflict avoidance techniques, as well as institutional cooperation and coordination. http://www.glogov.org/images/doc/WP30.pdf It concludes that neither legal nor political approaches are a panacea for interplay management. However, there is potential for the one approach to address the gaps in the other. Whereas international law does not address synergies between environmental treaties, strengthened political coordination and cooperation between them could. It is worth investigating further how international law and politics can work together in reaping synergies and addressing conflicts between multilateral regimes on climate change. In short, the very nature of climate change as an issue of sustainable development makes it almost impossible to capture all relevant aspects under a single legal regime, necessitating the consideration of interactions with other regimes. Similarly, it is not always necessary for two treaties to state their mutual supportiveness in order for States to implement them in a synergetic fashion. The main questions for international lawyers are: 1) can a conflict be established?; and 2) if so, which treaty prevails? CONFLICT CLAUSES The starting point in addressing conflicts is examining whether States have sought to regulate these through so-called conflict clauses (Pauwelyn 2003). The purpose of these clauses is to clarify the relation between treaties, thus preventing contradictions. This can be achieved, for example, by providing that existing treaties prevail or that a new agreement prevails over existing ones (Wolfrum and Matz 2003). It would not be advisable for the Paris agreement to rely on the adoption of conflict clauses due to their prioritising nature which doesnt conform to scientific management. In contrast, the climate agreements contain several clauses that regulate their relation with other multilateral treaties. With regard to the Montreal Protocol, the UNFCCC and the Kyoto Protocol delimit their scope by only covering greenhouse gases not controlled by the Montreal Protocol. Thereby, the climate agreements express awareness of the substantive interlinkages between the problems of climate change and ozone layer depletion, as some ozone-depleting substances are also greenhouse gases. However, it does not in itself prevent or resolve conflicts.Ãâà Another clause is relevant for an issue that has garnered much attention, namely the use of carbon sinks in the Kyoto Protocols Clean Development Mechanism (CDM). Forestry projects are to a limited extent eligible for emission reduction credits under the CDM rules. However, it is feared that these rules do not ensure the protection of biodiversity and the prevention of land degradation, and could hence conflict with objectives and obligations of other environmental treaties Although this provision does not state which agreements need to be taken into account, it is reasonable to assume that given the role of forests and wetlands as sinks, the Convention on Biological Diversity (CBD), the UN Convention to Combat Desertification (UNCCD) and the Ramsar Convention on Wetlands are relevant. Additionally, the membership of these agreements should be taken into account: it is difficult to see how an agreement can be relevant for a Party that has not signed or ratified it. However, it is unclear what precisely is meant with taking into account, leaving open the question which treaty would prevail in case of a conflict. TREATY INTERPRETATION Treaty interpretation is an important method that can be applied by diplomats and dispute settlement bodies to harmonise two norms that seem to be in conflict. Art 31 VCLT provides gives basic interpretation rules, stipulating that a treatys ordinary meaning, its context, and its object and purpose should be taken into consideration. It also gives more dynamic interpretation rules, which determine that interpretation should take into account a) any subsequent agreement between the Parties on interpretation of the treaty, b) any subseque nt practice in the application of the treaty, and c) any relevant rules of international law applicable in the relations between the parties. CONFLICT RESOLUTION RULES Article 30 VCLT provides rules on the resolution of conflicts. An apparent limitation of this provision is that it only applies to treaties relating to the same subject matter (Article 30.1 VCLT). Of course, application then depends on how one defines subject matter. On the one hand, if this is seen as broad as protection of the environment, Article 30 could theoretically apply to conflicts between the UNFCCC and CBD. The previous section has shown that international law does not particularly aim at enhancing synergies between treaties. Stokke (2001) points to the relevance of institutional coordination and cooperation in dealing with interactions. This could take place simply through information exchange between treaty bodies, or in a more ambitious form of comprising joint planning of programmes or even the coordina tion of substantive decision-making or implementation activities The climate regime has become increasingly involved in this form of interplay management.

Being that this play establishes itself as a memory play Williams is giving the audience a look at his own life, but being that the play is memory some things are exaggerated and these exaggerations describe the extremity of how Williams felt during these moments (Kirszner and Mandell 1807). The play centers itself on three characters. These three characters are: Amanda Wingfield, the mother and a women of a great confusing nature; Laura Wingfield, one who is slightly crippled and lets that make her extremely self conscious; and Tom Wingfield, one who feels trapped and is looking for a way out (Kirszner and Mandell 1805-06). Williams' characters are all lost in a dreamy state of illusion or escape wishing for something that they don't ha ve. As the play goes from start to finish, as the events take place and the play progresses each of the characters undergoes a process, a change, or better yet a transition. At the beginning of each characters role they are all in a state of mind which causes them to slightly confuse what is real with what is not, by failing to realize or refusing to see what is illusioned truth and what is whole truth. By the end of the play each character moves out of this state of dreamy not quite factual reality, and is better able to see and face facts as to the way things are, however not all the characters have completely emerged from illusion, but all have moved from the world of dreams to truth by a whole or lesser degree. Tom Wingfield makes a most interesting transition. He changes twice during the course of the entire play. One change occurs at the end of the memory part of the play, then he is changed again sometime between when the actual play took place and the time that he returns after serving in the merchant marines. In the beginning Tom Wingfield, the main character and the narrator of the play, feels trapped like a caged animal who needs to be set free which some times causes him to seem to be without pity or remorse (Kirszner and Mandell 1806).

When we meet Irwin again at the beginning of Act two he is a man now well into his forties and has moved on from teaching history in a school to filming a television history programme on location. We learn that he is five years older and yet there is a certain irony in the fact that he still recites the same mantra that he used with the ââ¬Ëhistory boys' when called in to prepare them for Oxbridge entry If you want to learn about Stalin study Henry VIII. If you want to learn about Mrs Thatcher study Henry VIII If you want to know about Hollywood study Henry VIII' It was all history. It seems that although older and now in a wheelchair his basic attitude and approach have changed little. He is now a ââ¬Ëpersonality' presenting a programme upon Rievaulx Abbey and life in monastic orders which he brings down to the level of ââ¬Ëtoilet arrangements' stating that he believes this to be the way to bring history to life and the Director reflects upon how he sounds a ââ¬Ëtad schoolmasterly'. Irwin, for all his changed position, having been transported from a life in the classroom to in front of a television camera, is still focussed upon viewing things from an unusual perspective and using language to effect as when he reflects upon the different materials being used in place of toilet paper, in effect saying that it is these artefacts which people now come to view saying of them, ââ¬Ëthere is an increment in excrement, so sanitised by the years and sanitised too' so he introduces a note of humour. Indeed he says of what he sees as ââ¬Ëmodern day pilgrims.' ââ¬ËWe are differently credulous and our cults are not the same but saner, wiser, more rationalâ⬠¦' He stumbles as if deeply absorbed in reflection of how people's attitudes have changed, yet he can use the same approach. We see that Irwin's approach to teaching and to history has not really changed from that which he expressed when first called in to prepare the boys for Oxbridge entry, For Irwin history is not a matter of conviction and he encourages the boys to be dispassionate and so distance themselves. It was perhaps evident from Irwin's first meeting with the boys that he was prepared to advocate whatever was required in order to gain the described objective. Irwin, the television presenter, has retained this belief in looking at these aspects of history which offer a more controversial approach to the subject. Initially describing the boys' work as ââ¬ËAbysmally dull' he recognised to be successful they had to attract attention by using unorthodox methods. His dictum, which was evident as a teacher, was evident when he said, ââ¬ËThe wrong end of the stick is the right one. A question has a front door and a back door. He then proceeded to express his opinion that history was a performance, For Irwin, unlike Hector, presentation was everything and he has interest in moral truth viewing things as being entertainment, so the first glimpse of Irwin the television presenter was evident even as a teacher. When referring to Stalin, whilst agreeing that he was a monster, he was still perfectly willing to say something in his defence. Thus, to him, the end justifies the means and he revels in being perverse. Irwin sums up the object of his approach, to the man who turns out to be none other than Posner, by describing it as ââ¬Ëmeretricious' and when called upon to define the word he describes it as ââ¬ËEye-catching, showy, false.' This last word almost appears as a damning indictment of his whole approach to teaching. When Posner replies by saying, ââ¬ËBut you were a good teacher' Irwin simply says ââ¬ËThe meretricious often areâ⬠¦ on television particul arly.' He then backs this up by reflectin that ââ¬ËThe wheelchair helps of course. Disability brings with it an assumption of sincerity.' We see that he was still prepared to use whatever vehicle to give him the edge and curry favour and sympathy. It was a means to an end, a prop but reveals him to be morally shallow. So it is that we are reminded of our initial meeting with Irwin when, still in a wheelchair, he was addressing three or four unidentified MPs upon the best way of presenting a bill before Parliament, the effects of which would, if examined, would prove to be very contentious concerned, as it was, with the effective ending of trial by jury in at least half of the cases which come before the courts abolishing with it the assumption of innocence. Sadly Irwin's views have become even more morally corrupted, perhaps the person we see before the television camera and addressing MPs is just the logical projection of the teacher who advocated taking a completely opposite or controversial view to attain a desired outcome. It is now just the case that his horizons are greatly expanded and he is able to suppress any moral feelings. He has obviously reached a stage where he is happy to twist debatable aspects to fit in with what he wishes to achieve. His views are well illustrated when he says in defence of a law change, ââ¬ËParadox works well and mists up the windows which is handy' We then come to appreciate how Irwin the television presenter views what he does by saying, ââ¬ËSchool. That's all it is. In my case anyway. Back to school.' He really had come to believe that history was ââ¬Ëa performance. Its entertainment. And if it isn't make it so.' Perhaps this last statement is so telling of his willingness to subvert the facts and in so doing taking an argument and endeavouring to prove its opposite as he had first done as a teacher who was willing to relegate moral truth for effect.

So, the service sectors contribute most of the development of national economy.The research aims are to analyze the comparative contribution of service sector with other sectors, the impact of trade liberalization of service sector and to provide the recommendations for development of service sector. It is taken a sample of ten years data of GDP from 2000-01 to 2009-10 for analyzing the comparison of service sector with other sectors (industry and agriculture). The average growth rates between service sectors and industry sectors or agriculture sector or total GDP are analyzed withââ¬Ëtââ¬â¢ test. The average growth rate of service sector, inudsty sector, and agriculture sector are 6. 17%, 7. 49%, 3. 21% respectively.The growth of service sector is more than the agriculture sector but less than the industry sector (result ofââ¬Ëtââ¬â¢ test). The paper also reveals that total trade deficit of service is increasing over the year. The average employment of Agricul ture, Industry, Service to total employment are 58. 89%, 12. 39% and 25. 36% respectively. Introduction The Economy of Bangladesh is growing one. It is basically divided into three basic sectors viz.Service, Agriculture and Industry. Among the Economic Sectors in Bangladesh, Service sector is most important. The contribution of service sector to the GDP is about 50% (Bangladesh Economic Review-2010). So, Service sectors influence the development of national economy. There is a latent demand for services in Bangladesh. To specify the need of services for huge population of Bangladesh, such sectors are to be opened for private entrepreneurs with required control. The enormous contribution of service sector and an increasing trend therein have played an important role in high growth of GDP.The analysis o f last few yearsââ¬â¢ data gives a clear idea on the phenomenon. The contribution of the industry sector to the economy of Bangladesh has been increasing day by day. For the purpose of national income accounting, Bangladesh Bureau of Statistics (BBS) divides the economy into fifteen sectors (Bangladesh Economic Review-2010, Ministry of Finance). 2. Problem statement From the growth of overall size of Economy, it is difficult to identify the significance of specific sector. Proper nurturing of significantly contributory sector, the growth of Economy may be resisted.Previously there was no difference between Services and Products. Service concept is the modern issue in the world. The most of the business is related to services. Even the product itself provides the service to the customers. So the services are the vital issue now. The economic sectors classified by Bangladesh Government are Hotel and Restaurant, Retail trade and Wholesale trade, Transportation and Communication, Rea l state and Renting, Financial Institution, Public Administration and Defense, Education, Health and Social Services, Community and Personal Services are included under Service Sectors.So they occupy a major share of total economics sectors. As a result, importance of service is significant. For Economic development we always think regarding industry and agriculture sectors rather service sectors. But major sector in the economy is service sector. In the modern world, service is required in every phase of life. People expect better service. But the growth rate of service sectors is either below expected level or not as per its importance in the economy. From this research the problems of service sectors are identified. For increasing the living standard of the people the service concept has come to lime light. Service marketing and service management will get the importance to develop the service sectors in Bangladesh.The research aims are to analyze the comparative contribution of service sector with other sectors, the impact of trade liberalization of service sector and to provide the recommendations for development of service sector. 3. Objectives of the Study Some specific objectives are set for this research. The principal objective of this study is to evaluate the comparative position of service sector. To accomplish this basic objective, following specific objectives are set: i. To conduct the comparative analysis of service sector with Agriculture and Industry sectors. ii..To analyze the im pact of Liberalization on Service sectors iii. To provide the recommendations for development of Service sector. 4. Methodology This research has used mostly secondary data have been used for analysis. Data have been collected from Bangladesh Economic Survey, Bangladesh Bureau of Statistics, Bangladesh Bank, World Bank, and Internet web sites, Books, Newspapers, Magazines and Journals. We have used required data for ten years from 2000-01 to 2009-10 for analyzing the contribution of economic sectors, growth rate of each sectors viz. service, industry and agriculture.Data of service export and import from 2004-05 to 2009-10 (five years) and the data of employment contribution for 9 years have been explained. 4. 1 Analysis of data: The data have been analyzed using graph, chart and some other simple statistical tools. The growth rate of service sectors (trend) is shown by graphical presentation. The total contribution of service sectors and sector wise share of major sectors are shown graphically. The average growth rates between service sectors and industry sectors or agriculture sector or total GDP have been compared by studentââ¬â¢sââ¬Ëtââ¬â¢ test. 4. 2 Hypothesis test 4. 2. The Contribution of Service Sector Off all the sectors, service sector is prominent one. Service sector has the growing potential to be driver of sustainable economic growth and significant poverty alleviation in Bangladesh.Service sector in Bangladesh is the largest sector. From the table 2(a), it is observed that the contribution of the service sector is a verage 49. 33%. It is steady over the period. The contribution of service sectors are 48. 77% in 2000-01 and 49. 90% in 2009-10. Figure-1 demonstrates contribution of different sectors in GDP. The groth rate of srvice sector is steady. The average growth is 6. 17%. The growth rates are 5. 43% ,6. 40%, and 6. 59% in 2001-02, 2005-06, 2009-10 respectively. 5. 2. From the Table 2(a), 2(b) and figure -2, it is shown that the average contribution of service sector, industry and agriculute sectors are 49. 33%, 28. 42%, 22. 25% respectively. So, the service sector is the half of total sector of economy. The growth rate of service sector, inudsty sector,and agriculture secture are 6. 17%, 7. 49%, 3. 21% respectively.Here, from the figure-2, it is seen that the contribution of service sector is steady. The contribution of industry sector is increasing with the reducing trend of agriculture sector. Here, aparently it is seen that the average growth rate of service sector is more the agriculture sectors and the total GDP growth and the average gorwth rate of industry sector is slightly mo re than the service sector. Now we shall statistically test whether the average growth rate of service sector is more than the agriculture sectors and total GDP growth and whther there is significant difference of growth rate between service sectors and industry sector. . Hypothesis test Since in the given data variances of population are unknown and the sample size is small we have used t-test from the table -6. The result of hypothesis test is in table 3. 6. 1. GATS was formed to eliminate the trade barriers.Here we shall see the impact of trade liberization on the service sectors of Bangladesh. From the table 4, the figure-3 is drawn. It is found from the figure -3 that the import of service average Tk. 199368 million is more than the export of service average Tk. 112214. 5 million. The total trade deficit is increasing over the year. The average rate of growth of service export is more than service import which are 16. 16% and 15. 89% respectively. This is a good symptom for Bangladesh. 8. Employment opportunity in Service sector Service sector has created a great scope for employment.Bangladesh is a labor intensive country. Population is an important resource of Bangladesh. From the table 5 (data is taken from world Bank data bank) the figure-4 is drawn and it is shown that average employment of Agriculture, Industry, Service to toal employment are 58. 89%, 12. 39 5and 25. 36% respectively. But employment of service sector is increasing. The employment of industry sector is increasing but agriculure sector is decreasing. 9. Recommendations for Service Sectors After analysis, it can be said that the contribution of service sector is about 49. 22% and the growth rate of service sector is 6. 75%. The contribution is about half of the total economic sectors and the growth rate is more than the avera ge growth of GDP. Emphasis is given on the service sector for development. Since the industry sector is growing rapidly (7. 49%), support can be given by providing the quality and smooth service. The employment in service sector is increasing day by day. So, there is lot of opportunity for employment in this sector. Though there is negative Trade Balance of service of Bangladesh, the growth rate of srvice export is more than that of import. It is a good symptom for us.So we have to emphasize the service export such as Tourism, Software, Transportation and Financial srvice etc. The prospects of some promising service sectors are pointed out below. 9. 1. Development of Tourism Tourism is one of the most promising sectors for Bangladesh with her huge natural beauty, heroic historical background and archaeological resources (Das & Chakroborty 2012). Bangladesh is a country of natural beauty. She has lot of tourism places. These places are of different interest like beaches, historical p laces, archaeological sites, religious palaces, forest and jungle etc. . 2. Development of Software and IT With the passage of time, the globe is being changed from analogue to automation. During last few years Bangladesh showed enormous success in Software and IT Sector which can enlarge the extent of her service market (BASIS 2010). The current size of Bangladesh IT Industry and software/ITES industry is still smaller compared to the overall economy and the number of population (over 150 million). Over the last few years the industry has been grown considerably and is expected to grow at that rate for some time. 9. 3.Information Communication Technology (ICT) With the hope of great development, the govrnment of people republic of Bangladesh introduced National Information and Communication Technology (ICT) Policy in October 2002. This policy document guides the development of a country-wide ICT-infrastructure for human resources development, governance, e-commerce, banking, public utility services and all sorts of on-line ICT-enabled services by 2006. 9. 4. Improvement in Transportation Transportation is an important sub-sector of total service sector. It includes different type of transport for example road transport, waterways, railways, and airlines.Of these, road transport is mostly used means of transport. Road transport in Bangladesh is a private sector affair operating predominantly in domestic routes. 181 Research Journal of Finance and Accounting ISSN 2222-1697 (Paper) ISSN 2222-2847 (Online) Vol 3, No 5, 2012 www. iiste. org Rates are among the cheapest in the world. Express and non stop services are available. Total Highways is 204,022 km of which paved is 25,095 km and unpaved is 178,927 km (1996 est. ) (bangla2000. com). 9. 5. Quality Financial Services Financial service is another important part of total service sector in Bangladesh.It is a promising sub sector which consists of the Bangladesh Bank (the central bank), four nationalized commerci al banks (NCBs), 5 stateowned specialized banks (SBs), more than 30 private sector commercial banks (PCBs) and more than 9 foreign commercial banks (PCBs). The rest of the financial sector consists of more than 29 non-bank financial institutions, the capital market, 3 general and 17 life insurance companies, the cooperative banks and the microfinance institutions. 9. 6. Development of Education sector For increasing of people and literacy rate, the demand of higher education is increasing.The technical institution, Business education, health education create the demand to the people. The development of government and private universities is the indicator of growing demand of education sector. 10. Concluding Remarks The contribution of service sector is about 50 percent of the total GDP. So, the growth rate of GDP depends on the service sectors. The service sector provides the support for the development Industry sector and agriculture sector. For the international trade (export and import), the smooth transportations, financial and insurance service is required.For the improvement of the GDP sector, it has to give special emphasize on service sectors. There is lot of scope of development of service sector. Bangladesh is providing transit and transshipment to India, Nepal and Bhutan that will increase return from the transportation and communication sector. The manufacturing sector is growing rapidly. So, the need of financial service and education is increasing in future. Tourism, hotel service is promising in Bangladesh. The trade liberalization on service will cause the opportunity for service export. So, we have to take the initiatives for development of service sectors.This paper has analyzed the comparative contribution of service sector, the growth of service sector, service export and the employment in service sectors.
